Basic requirements
In most cases, you must be in a relationship with (or be) the spouse (married) or de-facto partner of:

_ Australian permanent resident or eligible New Zealand citizens

Who can apply for a spouse sponsorship visa (subclass 820, 801 visa)?
- You must be married or in a de facto relationship with an Australian citizen, Australian permanent resident, or eligible New Zealand.
- Your relationship must be proven to be an exclusive, committed, genuine, and continuing relationship.
- Your relationship must be able to prove, cumulatively, that you and your partner meet the following four factors:
- Joint financial aspects of the relationship.
- Join the nature of the household arrangement.
- The social aspects of the relationship.
- The nature of the couple’s commitment to one another.
- For couples who are in a de facto relationship, the law stipulates that the length of the relationship must be at least 12 months duration. However, there are exceptions to this requirement including when the relationship has been registered under a law of a State or Territory prescribed in relevant legislation.
- You must meet health and character requirements.
Requirements of being granted a spouse visa (subclass 820, 801)
Temporary residence visa (subclass 820)
- Prove that you are married or in a domestic relationship (for at least 12 months) with an Australian citizen, Australian permanent resident, eligible New Zealand citizen
- You have a sponsor when you apply and it is approved by the Australian Department of Home Affairs
Permanent residence visa (subclass 801)
_ You have a temporary residence visa (subclass 820)
_ You are in a spousal or cohabiting relationship with an Australian citizen, Australian permanent resident, or eligible New Zealand citizen
_ You do not change the guarantor. The person who sponsored you when applying for a spouse sponsorship visa continues to sponsor you 2 years after you are granted a temporary residence visa (visa 820).
Process of applying for a partner visa (subclass 820, 801)
Step 1: Find out the application conditions
You need to find out the requirements for this visa and determine whether you are eligible to apply.
Step 2: Apply for visa subclass 820 and visa subclass 801
- Gather all the documents
- Notarized translation of all documents into English
- Scan all documents in color with translations and save them as separate files.
- Monitor and receive notifications from the Ministry of Home Affairs
- Provide biometrics (when requested)
- Physical examination
- Prepare documents
- After applying
Step 3: Receive visa subclass 820 results (temporary residence visa)
- After completing the application process, you can check the status of your application through:
- Application status check tool for Evolve customers
- If you are granted an Australian temporary residence visa (visa 820), you are eligible to continue to be considered for a permanent residence visa (visa subclass 801).
- If you are granted a permanent residence visa (subclass 801) immediately after being granted a temporary residence visa (subclass 801 visa), you will not need to do anything else.
- If you have not been granted a permanent residence visa immediately to be eligible to settle in Australia, you need to proceed to step 4.
Step 4: Supplement documents after 2 years
- Prepare documents
- Notarized translation of all documents into English
- Scan all documents in color with translations and save them as separate files.
- Supplement online documents (maximum 1 month before 2 years from visa 820 issuance)
- Upload previously prepared documents.
